Chapter 13 Reorganization
Chapter 13 is generally referred to as "debt consolidation" or "debt reorganization". A "plan" is proposed to pay back your creditors over a period of between 3 to 5 years. Chapter 13 is useful in paying back debts that cannot be taken care of in Chapter 7. Some circumstances where we recommend Chapter 13 include:
1. You owe back house payments but want to keep your house (you pay the back house payments in the "plan" while making your regular mortgage payments after the case is filed),
2. You want to "strip" or "avoid the lien" of the 2nd trust deed on your house,
3. You have a lot of non-dischargeable debts like federal/state taxes; student loans; child support,
4. You have assets that cannot be protected if you filed a Chapter 7 bankruptcy,
5. You filed a Chapter 7 bankruptcy and cannot currently re-file due to time in between filings,
6. You are over the limit or have disposable income in accordance with the "Means Test",
